Fundamental right of data protection in Hessia

Since the referendum at October 28th of 2018, the Hessian Constitution has included regulations on the protection of data. With the new Article 12a, self-determination regarding the disclosure and use of personal data is now included in the constitution as a fundamental right. The protection of information technology systems will also be enshrined as a fundamental right.
With the amendment, data protection and the protection of information technology systems have been included as fundamental rights in the Hessian Constitution and may therefore only be restricted by a law.
The new Article 12a reads:
"Everyone has the right to decide for himself about the disclosure and use of his personal data. The confidentiality and integrity of information technology systems are guaranteed. Restrictions of these rights require a law".
